How many different state tax rates are there in the US?

There’s currently 41,702 individual ZIP codes in the United States, each of which is used for tracking mail and gathering geographical statistics. In an ideal world we could use ZIP codes to organize tax rates, however due to some states authorizing cities, counties or their local districts to set their own tax rates, we end up with multiple tax rates in one ZIP code! What a f***ing nightmare. We’ve condensed our file to 28,342 individual tax rates which cover all 50 US states. Come get some baby.

Do I need to collect sales tax in the US?

Yes. The US Supreme Court has changed the game and ruled that states can now decide to collect sales tax. Not all of them decided to, but most of them do.

The short answer is that the State will assume that it is obliged to collect sales taxes if your business has a sales tax nexus in that State. There are several different scenarios where non-US salespeople may have a nexus with the United States.

If you live and conduct your business in the US but are not a US citizen – non-US citizens who conduct business in the US are still considered to be subject to sales tax and must comply with sales tax laws as if they were US citizens.

If you live outside the U.S. but have a U.S. compound sales tax – If your business meets any of the U.S. compound sales tax criteria, that state will require you to register for a sales tax license in that state and collect sales tax from all customers in that state. It is important to note that you should never collect sales tax from buyers in the US without a sales license. This is considered illegal! Remember that there is no sales tax in five US states – Alaska, Delaware, Montana, New Hampshire and Oregon. This means that you will not be required to collect sales taxes in those states, even if you have space, employees, or inventory there.

If you live outside the US and don’t have a fiscal connection with the US, then you won’t have to worry about registering for a sales tax license and collecting taxes. You can still sell goods to customers in the US, but if you don’t have a tax link in any US state, you won’t have to pay sales tax in the US. Congratulations!

How do I charge tax on WooCommerce?

When you open an online store, there are many things you have to jump through and get everything running smoothly. The management of a WooCommerce store requires that you take care of inventory, article management, payment and shipping, and much more. But one of the most tedious tasks we forgot to mention is the tax management at your WooCommerce store.

WooCommerce offers a simple guide on how to establish taxes in your online store. First of all, you need to activate the tax rates option in the general settings. Then go to WooCommerce> Settings> Taxes and create taxes in your online store.

To get taxes to work in WooCommerce, first you need to enable them.

Step 1. Go to: WooCommerce -> Settings -> General.
Step 2. Select the ‘Enable Taxes and Tax Calculations’ option.
Step 3. Save your changes by clicking the blue save button.

What is the sales tax for digital goods?

The United States, along with the rest of the world, has embraced the value and convenience of the e-commerce market. We buy our music, books, movies, applications and other products and services online and deliver them directly to our phones, tablets or other storage devices. In the last decade alone, billions of books, films and applications have been delivered electronically to consumers around the world.

In the United States, many states believe that the recent drop in tax collection was caused by an increase in online digital shopping. Therefore, states are looking for ways to collect taxes on digital goods and electronic transactions. States have been finding different ways to collect taxes on digital goods. Some states have simply taken advantage of existing sales laws and used them. Other states have passed new laws specifically designed to tax digital goods that are accessed or downloaded online.

What is a digital asset or digital good?

Digital goods, sometimes referred to as digital products, electronic goods, or electronic goods, is a generic term used to refer to certain goods that are stored, delivered, and used electronically. Digital goods are sent electronically to the consumer via e-mail or downloaded from the Internet. Digital goods usually come as an e-mail attachment or are downloaded via a secure connection from a website. Common examples of digital goods are electronic books, music files, software, digital images and manuals delivered in electronic format. In fact, a digital asset can be any item that can be delivered electronically. However, transactions related to electronic banking have traditionally been considered to be outside the definition of a digital asset. In addition, digital goods generally do not include online web hosting, software, data processing or information services.

Taxation of digital goods under state sales tax rules

Approximately 20 of the 45 US states currently do not have tax legislation on digital goods because they either do not have the ability to tax electronically delivered goods or have specifically designated digital goods as not subject to sales tax.

The remaining states disagree with the one-size-fits-all methodology for taxing digital assets. Four general state classifications are used to classify taxable digital assets:

  • Quoted Digital Goods.
  • Tangible Personal Assets.
  • Tangible functional equivalents.
  • Services

Some states have specifically identified and defined which digital goods are subject to sales tax. For example, one state has defined digital property to include the following goods that are delivered or available electronically:

  • Audio works;
  • Audiovisual works;
  • Books, magazines, newspapers, newsletters, reports, or other publications; and
  • Photographs or greeting cards.Thus, if a digital asset is not one of those specifically listed above, the product is not classified and taxed as a digital asset in the State.

Looking to the Future

To address the complex tax and sourcing issues associated with digital assets, the U.S. Congress passed the Digital Goods and Services Tax Equity Act of 2019. This law is intended to promote neutrality, simplicity and fairness in the taxation of digital goods and services. However, this bill and similar bills introduced in previous years have not yet been passed by Congress. It remains to be seen whether Congress will pass in the near future the necessary legislation to help ensure uniform rules for taxpayers.

In today’s business environment, as the position on the taxability of digital goods varies from state to state, a digital vendor must conduct a state-to-state analysis to determine the tax treatment of sales of his digital product. Sellers should carefully review the statutes, regulations, ordinances and individual policy statements of each state in which they do business to ensure they comply with their sales tax laws.

How do I collect sales tax?

In short, you have to collect taxes from clients in that state. But, as on the sales tax, how much you collect is not so simple. Your first task is to legalize in the state and register.

Register for a sales tax license
To legally collect sales tax, you must register for a sales tax license in the state(s) in which you have a connection. (This is sometimes called a sales tax license).

In order to obtain a sales tax license, states require all vendors who have a sales tax link to the state register in that state. You can find instructions on how to register with your state’s revenue department. These authorizations can usually be obtained for free or at a very low cost.

When you obtain your sales tax authorization, your state will also give you instructions on when and how to file your sales tax return. States consider it illegal to collect sales tax on your behalf without authorization, so do not skip this step.

Note on taxable items: Some items are not subject to sales tax in some states. For example, most items of clothing in Minnesota are not taxed, while groceries in Arizona are not taxed. If you suspect that you are selling duty-free items, always contact the state tax department. Generally, states are very strict in determining tax-exempt goods.

Determine how much to collect
Your next step is to determine what sales tax you need to collect. Again, this is easier said than done, especially for online vendors.

States set the sales tax rate and then localities can add a percentage to that rate. For example, in postal code 90210, the tax rate is 6% for the entire state of California, .25% for the county of Los Angeles and an additional 3.25% for the local tax code, for a total of 9.5% of the sales tax rate.

If you operate a boutique in Beverly Hills, sales tax compliance is quite simple. The client will be charged 9.5% sales tax. For example, if someone bought a pair of sunglasses for $200 at your boutique, they would be charged $219. That’s $200 for the sunglasses and $19 for the 9.5% sales tax.

But this can be complicated for online sellers, especially sellers with a nexus of sales taxes in multiple states. This is because the rules for sellers who sell sunglasses to buyers within their state (where their business is based) are different from the rules for sellers who sell sunglasses to buyers in other states where they have a sales tax link.
